Apria Healthcare and Resmed Warranty question

Apria Healthcare and Resmed Warranty question

Everyone. I purchased a Resmend Airsense 10 and a SoClean machine on the same day in April 2020 from Apria. However, this is on the Resmed website: Effective February 1, 2020 ozone damage is specifically excluded. So they sold me a device that they knew would void the warranty of the product they sold me. My question is, do you think I have any recourse? I will try and get them on the phone tomorrow, but I'm curious as to what others think. The Resmed has the foam breakdown that is caused by the Ozone.

I would have my attorney contact Apria, and let them know
you will be EXPECTING a new Airsense.
Free of charge.
And I would also demand a full refund for the g--d Soclean.

Personally, I think you're SCREWED. I don't think you can PROVE they FORCED you to purchase it.
Apria and almost every other DME have dubious reputations about telling the truth.
You should have known that going into this.

While I agree you didn't do your homework and we all know that is hard when you are first starting out - I think you may have a case. I think it's worthwhile to talk to a lawyer but I would look for a large law firm that handles medical cases - it shouldn't cost you to have them take a look and get an opinion. If they want money upfront don't back away - run.

Apria is a very sketchy company - as you now know. If you haven't already stopped doing business with them you are part of the problem by feeding them your money - insurance money as it may be it keeps them alive and cheating the next person.

I have to admit that is pretty shady of Apria to sell you cpap equipment AND something that will destroy it early so you will need to buy another cpap before its time. This is evidence they are NOT known for their ethics.

I have stated many times on the forum that CPAP users investigate more and know more about their cell phones (before they buy them) than they do about these (flow generators) "breathing devices" that they will use every night for the rest of their lives. These flow generators are FAR more important for a person's well being than their cell phones!

Let's just say that I knew a helluva lot about my CPAP machine before I ever started using it. That's also why I chose Respironics (at that time) over ResMed or other brands. The availability and ease of use of the Encore software was also another factor. And, in hindsight, I still have no regrets with the choices I made 16 years ago.

Having spent many years as a consultant helped me prepare for this part of my life, too.

That is a valid viewpont...OTOH, a CPAP is a medical device and I don't run around second-guessing my medical professionals. Granted, a DME is not a medical professional, but when starting out on CPAP not all of us know that. I was fortunate enough to know a little and did do some research (my husband was a PAPer, who did not use a DME, did not need to replace masks often!), and lucked into a great DME after an initial, horrible, first phone call with Crapia!

I have no dog in this fight, just wanted to comment on this little piece. You shouldn't. I work in pharmacy and our motto is "Trust no one". Doctors screw up, assistants screw up, fellow co workers screw up. Check and double check and then triple check everything. Do you know how many medical errors we fix a day ?

Consumer awareness classes should be offered in school--maybe even required.
The costs could be shouldered by the stinkers they catch.
