Where to sell a used CPAP machine?

I hope it's ok to post this type of question. If so, moderator, please delete it.

I wondering if anyone on here knows anyplace where I can sell a used CPAP machine. The machine I have is a Remstar Plus. My ex-wife used it for one week and stuck it in the closet. Anyway, I was cleaning out the closet and figured I would try to sell it to someone that could use it. I am just not sure of anywhere I can sell this at. Ebay stopped allowing the sale of CPAP equipment, or I would just sell it there. Any advice would be appreciated. Thanks.

Hi Dhawk,

You can try Yahoo Auctions or also Overstock.com has just launched a new auction site.

How old is the machine? Do you know if it has c-flex? Do you have all the documentation and accessories or just the machine?

To save yourself some troubles I would first ask your ex-wife if she still wants it (if you haven't already done so).

[I wonder if you would consider donating it to a free clinic here in Vancouver, WA. I volunteer at a clinic that provides medical care for people who can't afford medical care, and we have a number who have sleep apnea and can't afford a machine. I can get you a tax receipt. We can pay for shipping costs.

Unfortuneately I believe one needs a liscense to resell a cpap. I tried several times to purchase one on Ebay, only to have Ebay cancel the sale. I looked up the regulations and got very confused. People do still sell them however.

Prescription items are forbidden for sale on eBay.
CPAP machines are forbidden because they require a prescription.

So if someone sent a prescription, even if it's used, a private party could sell it. Right?

If you find that you cannot sell your remstar, this might be another option for you. I donated my old humidifier this way:

So it either has to be sold by a physician or on his order (prescription). The idea that these devices do not require a prescription is plain false. CPAP.COM and other online merchants will NOT sell you a CPAP without a Prescription. It has nothing to do with the pressure setting, it has everything to do with federal law.

I contacted the FDA regarding selling CPAP's online and was told that the person buying it has to have a prescription, AND additionally, it has to be sold as the manufacturer sold it. (otherwise it is considered rebranding)

Can you sell it and not get caught? Probably. Is it legal to do without the person on the other end having a prescription? No. Will the FDA get you for a single sale? Probably not again.

Seeing that the question was is there a place to sell it, the answer is yes, Yahoo. Is it legal is a different question, and if someone doesn't meet the above 2 requirements, they *might* be the next test case for illegally distributing prescription devices. (the likelihood of this isn't high, but I know I don't want to try my luck...)

You will probably do better to donate the equipment to your local hospital or one of the other places listed above.

Then how do virtually every dme including cpap.com sell masks and peripherals?

They have the identical wording.

My Breeze mask package does?

Where is the law?

Drugs are prescribed, tests and equipment are ORDERED.

dme's not licensed to dispense prescriptions.

As long as the person has a prescription (order) for CPAP, AND they sell it as the manufacturer sold it, then yes, you could sell it to anyone.

The conversation I had with the gentleman from the FDA even involved Ebay. Ebay took a stance that was more strict due more to pressure they received from Resmed, not the FDA. The gentleman from the FDA said that as long as they state that the above requirements are met, that would be good enough. Unfortunately for us, they caved to pressure from Resmed and took the stance of no CPAP...

someone please find the law that cpap requires a Rx to be sold.

I am trying to figure out why Resmed would objest to ebay selling PAP, other than they wouold like to sell a new one if a person needed one.

ANd did Resmed/others put this wording on the machines for this purpose?

The CPAP machines always go under Product Code BZD, Regulation# 868.5905. A typical application is shown in the request by F&P for their HC200, which also shows the prescription required at the end of the application.

Don't forget the state codes as well, where there is a far greater likelihood of somebody actually coming out and making a big deal, especially if someone lodges a complaint.
